Veterans Triumph – Terms of Service

1. No Affiliation with Government Entities

Veterans Triumph is a privately owned company and is not affiliated with, endorsed by, or sponsored by the U.S. Department of Veterans Affairs (VA), the Department of Defense (DoD), or any other government agency or entity.

All information provided through our Services is for informational and educational purposes only and does not constitute official guidance or correspondence from any federal agency.

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to access and use the Services. By using our Services, you represent and warrant that you meet these eligibility requirements.

3. License and Acceptable Use

Subject to your compliance with these Terms, Veterans Triumph grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

You agree not to:

• Use the Services for any unlawful purpose, or in violation of any local, state, national, or international law;
• Misrepresent your identity or intentions in using the Services;
• Submit false or misleading information through our tools, including to any government agency;
• Impersonate any individual or entity, including a VA employee or representative;
• Attempt to gain unauthorized access to any systems or data;
• Reverse-engineer, decompile, modify, or create derivative works of any part of the Services.

4. Informational Nature of Services – No Legal, Medical, or Professional Advice

The content and tools provided by Veterans Triumph — including but not limited to the secondary claims tree tool, personal statement generator, buddy letter generator, and mock C&P (Compensation & Pension) exam simulations — are for informational and illustrative purposes only.

We do not provide:

• Legal advice or representation;
• Medical evaluations or diagnoses;
• Any guarantee regarding VA claim outcomes.

You should consult with accredited representatives, attorneys, or licensed healthcare professionals before making any decisions regarding your VA benefits or health conditions.

Use of the Services does not establish a provider-patient, attorney-client, or fiduciary relationship between you and Veterans Triumph.

5. AI-Generated and User-Generated Content

Our Services may use artificial intelligence to generate content based on your inputs. You acknowledge and agree that:

• AI-generated content may contain errors, omissions, or inaccuracies;
• All output is intended for guidance and reference only;
• You assume full responsibility for reviewing, editing, and validating any content prior to its use.

Veterans Triumph is not liable for any harm, denial of benefits, or adverse outcomes resulting from your use of generated content.

6. Privacy and Data Security

Our collection, use, and storage of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.

We implement reasonable security measures to protect your data, but no method of transmission or storage is 100% secure. You acknowledge that any use of the Services is at your own risk with respect to data privacy and confidentiality.

We do not share your data with the VA, unless required by law or with your explicit consent.

7. Subscriptions, Billing, and Refunds

Certain features of the Services may require payment of fees. By selecting a paid subscription or purchasing a service, you agree to the pricing, billing frequency, and refund policy presented at the point of sale.

Veterans Triumph reserves the right to change its pricing or billing structure at any time with reasonable notice.

Refunds are not guaranteed and will be issued at our sole discretion, unless otherwise required by applicable law.

8. Intellectual Property

All content, software, trademarks, and branding contained in the Services, excluding user-submitted materials, are the intellectual property of Veterans Triumph or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, modify, reproduce, distribute, or exploit any part of the Services without our prior written consent.

9. Termination and Suspension

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms or for conduct we reasonably believe is harmful to our business or other users.

Upon termination, your license to use the Services shall immediately cease.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT:

• THE SERVICES WILL MEET YOUR NEEDS OR EXPECTATIONS;
• OUTPUTS WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR SUBMISSION TO THE VA;
• ANY BENEFITS OR CLAIM RESULTS WILL BE OBTAINED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VETERANS TRIUMPH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Veterans Triumph and its officers, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys' fees) arising from:

• Your use or misuse of the Services;
• Any content you generate or submit;
• Your violation of these Terms or applicable law;
• Your submission of VA claims or documents derived from our platform.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

You agree that any disputes shall be resolved exclusively in the state or federal courts located in Delaware. You waive any objection to personal jurisdiction or venue in those courts.

14. Modifications to Terms

We may update these Terms at any time. Material changes will be posted with reasonable notice. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
